Terms of service

1 · The agreement

These Terms of Service ("Terms") form a binding contract between Team OmAk Pvt. Ltd., operating the GrowYu service ("GrowYu", "we"), and the entity or individual who creates a GrowYu workspace ("Customer", "you"). By creating a workspace, you accept these Terms. If you accept on behalf of a company, you confirm you have authority to bind that company.

Enterprise customers may have a separate Master Service Agreement; where it conflicts with these Terms, the MSA wins.

2 · The service

GrowYu provides a cloud-hosted tele-CRM, mobile applications, and supporting integrations as described on growyu.com. We’re free to evolve features, add capabilities, and retire underused ones with reasonable notice (at minimum 90 days for any retirement that affects you).

3 · Your account

• You’re responsible for keeping your workspace credentials secure and for all activity under your workspace.
• Each user must use their own login; account sharing is prohibited.
• You must provide accurate business details for KYC, GST invoicing, and DPDP compliance.
• You’ll notify us promptly if you suspect a breach of your workspace credentials.

4 · Fees & payment

Tier pricing is published at growyu.com/pricing. Pricing is flat per workspace at each tier; we do not bill per user. Indian taxes (GST) are applied where applicable; international customers may pay in USD with applicable local taxes.

• Subscriptions auto-renew monthly or annually, depending on your selection. Cancel anytime; no refund for partial periods.
• Usage above capacity caps (call mins, AI summaries) is billed per the pricing page’s overage table.
• Late payments accrue 1.5%/month after a 14-day grace period; we may suspend access after 30 days past due.

Plain English. Pay the flat fee, use the service for the month, cancel whenever. No surprise per-seat charges.

5 · Your data

Customer data belongs to you. We process it solely to provide the service, as set out in our privacy policy and DPA. You’re responsible for the lawful basis on which you collect and process end-customer data (consent, contract, etc.) through GrowYu.

6 · Acceptable use

You won’t use the service to:

• send spam, telemarketing without consent, or messages violating DLT / WhatsApp Business policies;
• harass, threaten, defraud, or impersonate any person;
• collect data from minors without verifiable parental consent;
• reverse-engineer, scrape, or attempt to derive source code from the service;
• resell access to your workspace without a written reseller agreement;
• introduce malware or attempt to circumvent rate limits and security controls.

7 · Suspension & termination

We may suspend or terminate your workspace if you breach these Terms, fall materially behind on payment, or use the service in a way that risks the platform or other customers. For non-payment we’ll notify and grant a 14-day cure period (longer for Enterprise). For acceptable-use breaches, we may act immediately and notify you.

You can cancel at any time from the workspace settings. On cancellation, your data follows the retention & deletion timeline in our privacy policy.

8 · Intellectual property

The service, including software, design, and documentation, is owned by Team OmAk Pvt. Ltd. or our licensors. We grant you a non-exclusive, non-transferable right to use it during your subscription. You own your data; we receive no rights to your data beyond what’s required to operate the service.

9 · Warranties & disclaimers

We warrant that the service will materially conform to the documentation. Beyond that, the service is provided "as is" to the maximum extent permitted by law. We don’t guarantee uninterrupted service except where an SLA is in writing (Enterprise tier).

10 · Limitation of liability

Except for breaches of confidentiality, IP infringement, or willful misconduct, neither party will be liable for indirect, consequential, or punitive damages. Aggregate liability is capped at the fees you paid in the 12 months preceding the claim.

11 · Governing law & disputes

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. Both parties agree to attempt good-faith resolution before filing.

12 · Changes to these terms

We may update these Terms with at least 30 days’ notice to workspace owners. Continued use after the effective date means you accept the new terms. If you don’t, you can cancel before the new terms take effect.
